Your privacy is important to us. It is Hoppel Design’s policy to respect your privacy regarding any information we may collect while operating our website. Accordingly, we have developed this privacy policy for you to understand how we collect, use, communicate, disclose and otherwise make use of personal information. We have outlined our privacy policy below.

Visitors to Our Website

When someone visits https://hoppeldesign.com we use a third party service, Google Analytics, to collect standard internet log information and details of visitor behavior patterns. We do this to find out things such as the number of visitors to the various parts of the site. This information is only processed in a way which does not identify anyone. We do not make, and do not allow Google to make, any attempt to find out the identities of those visiting our website. If we do want to collect personally identifiable information through our website, we will be up front about this. We will make it clear when we collect personal information and will explain what we intend to do with it.

Use of Cookies by Hoppel Design

Cookies are small text files that are placed on your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site. For more information about how cookies work, click here.

The list below explains the cookies we use and why.

  • __stripe_sid (session cookie for Stripe, the company we use for credit card processing)
  • PHPSESSID (To store a the logged in user’s username and a 128bit encrypted key. This information is required to allow a user to stay logged in to a web site without needing to submit their username and password for each page visited. Without this cookie, a user is unable to proceed to areas of the web site that require authenticated access. This cookie is a reference to a session stored on the web server. No information is stored in the user’s browser and this cookie can only be used by the current web site. This cookie expires when your browser is closed.)

E-Newsletter / Mailing List

We use a third party provider, MailChimp, to deliver our occasional e-newsletters. We gather statistics around email opening and clicks using industry standard technologies including clear gifs to help us monitor and improve our e-newsletter. Security and Performance

We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.

Hoppel Design uses a third party service to help maintain the security and performance of the Hoppel Design website. To deliver this service it processes the IP addresses of visitors to the Hoppel Design website.

This entire website is encrypted, and all data is transmitted to and from us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, troubleshooting tech problems you’ve inquired about) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

Collection of Personal Information

We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to develop the content/program for which you have signed on.

We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.

Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.

We will collect and use personal information solely for fulfilling those purposes specified by us and for other ancillary purposes, unless we obtain the consent of the individual concerned or as required by law.

Further, Hoppel Design does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

Limitations

In no event shall Hoppel Design or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Hoppel Design’s website, even if Hoppel Design or a Hoppel Design authorized representative has been notified orally or in writing of the possibility of such damage. Hoppel Design has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. Including any link does not imply endorsement by Hoppel Design of the site. Use of any such linked website is at the user’s risk.

Hoppel Design may revise these terms of service for its website anytime. Using this website, you agree to be bound by the current version of these terms of service.

Governing Law

These terms and conditions are governed by and construed by the laws of Pennsylvania and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Client Policies

The following policies explain how we collect payments, how refunds are processed, and our relationship with clients.

Payment Methods

We accept payment via check, major credit card, and PayPal. Generally, we send out electronic invoices that can be paid online with a credit card. If you have a payment preference, please let us know and we will invoice you accordingly. Unless otherwise stated on the invoice, payments are due upon receipt.

If paying by check, please make checks out to Adrian Hoppel and mail payments to 434 Naomi Street, Philadelphia, PA 19128.

Custom Work Payments

Payments for custom work (including website design, website development, logo design, and graphic design) are due according to the schedule in the Statement of Work (SOW). Invoices will be sent for all payments, and unless otherwise stated, payment is due upon receipt.

Custom Work Cancellation

The client may cancel the project at any time; payments are non-refundable. Hoppel Design will bill the client for any work completed up to the day of cancellation over any payments already received.

If Hoppel Design requests a response or feedback from the client and we do not hear from the client for over two weeks, Hoppel Design may suspend the project and reset the timeline; if we do not hear from a client for over a month, Hoppel Design may cancel the project altogether. We will not refund payments in this scenario.

Unless Hoppel Design notifies a client in advance that we will be unavailable, if the project is active (not suspended or canceled) and Hoppel Design fails to respond to client requests for feedback or updates for more than two weeks, the client may cancel the project and request a full refund of any deposits paid. Note: This is the only scenario in which Hoppel Design will refund payments.

Custom Work Timelines

The timeline included with any proposal is the best estimate of Hoppel Design, based on our projected scope of a specific project and our current workflow. Any number of variables can delay a project. It is not uncommon for projects to finish ahead of schedule, and it is also not uncommon for projects to extend for weeks or even months beyond the original estimated completion date. Both Hoppel Design and the client must agree to be forthcoming and transparent about any issues that may arise which could cause a delay in a project and to do our best to work with each other as best we can to complete the project as efficiently as possible.

If the scope of a project changes significantly, Hoppel Design may require a new estimate to be approved. If the client declines the new estimate, Hoppel Design will continue according to the original estimate and complete the project, or the client may cancel the project. Should the client decide to cancel for this reason, Hoppel Design will not refund payments, and we will bill the client for any work done up to the day of cancellation over the payments made.

3-Year Warranty on Custom Websites

We will repair or replace, at our discretion, and at no additional cost, any custom website work that stops functioning properly for up to 3 years after your website goes live.

This warranty specifically only covers our original work and your use of that work as intended (posting blogs, registering people, taking payments, etc.). Modifications, including adding new plugins, adding new themes, or making changes to any theme or core files (including the CSS file), made by Hoppel Design are covered but do not extend the warranty.

Any modifications made by the client, the client's employees, or by any other person not associated with Hoppel Design are not covered. Repairs to any other part of the website that stops working properly due to modifications made by the client, the client's employees, or by any other person not associated with Hoppel Design are not covered.


Website Hosting Payments

Hosting payments are due one month in advance and are not refundable. Monthly hosting plans use calendar months; annual hosting plans use January through December unless otherwise stated. Hosting will be suspended at the end of the paid month if any payment due remains unpaid.

Website Hosting Cancellation

You may cancel your HD Managed Hosting at any time; we will assist with moving your website to a different host with a 30-day notice.

If your website becomes a liability to our server environment (due to malware, hacking, outdated or unsupported website plugins or add-ons, or any other reason we cannot quickly resolve), Hoppel Design may need to quarantine your websites. Quarantined websites may need extensive work to fix, and if you are unwilling to complete this work, Hoppel Design may remove your website from our server and assist you in placing your website with another host. Any payments made are not refundable.

100% Uptime Guarantee on Hosting

We expect our server, and thereby your website, to be "up" or accessible by the public at all times. If you experience downtime due to our server, we will credit you at 10x the amount of time you were down.

Any planned updates to the server with at least 72 hours of notification to you are not covered. Any downtime due to modifications made by you, your employees, or any other person not associated with Hoppel Design is not covered.


Hourly Support Payments

Hourly support work will be based on a Statement of Work (SOW) signed by both Hoppel Design and the client and will include a 50% deposit to be paid in advance.

Monthly Support Payments

Monthly support work will be invoiced in advance. Hours will be available beginning with payment and for 30 days after that. Unused hours are not refundable and do not roll over to the next month. Monthly support plans will be invoiced every 30 days until the client cancels the plan. If payment is not made on time, the plan will be suspended until payment is made; if payment is not made within 30 days, the plan will be automatically canceled.


Project Cancellation

The client may cancel the project as detailed in the SOW at any time; payments (including deposits) are non-refundable. Hoppel Design will bill the client for any work done up to the day of cancellation over any payments already received.

If Hoppel Design requests a response or feedback from the client and we do not hear from the client for over two weeks, Hoppel Design may suspend the project and reset the timeline; if we do not hear from you for over a month, Hoppel Design may cancel the project altogether. We will not refund payments in this scenario.
